م MEHFIL
COUNSEL REVIEW DRAFT

Your photos. Your rights. Your responsibility.

1. Operator and legal status

The service is operated by [LEGAL OWNER OR COMPANY NAME], referred to as "Mehfil", "we", "us" or "our". Contact and jurisdiction details below must be completed before launch. These Terms are intended to operate under the laws of Pakistan, including the Prevention of Electronic Crimes Act, 2016 as amended in 2025 ("PECA"), applicable subordinate rules and other applicable laws.

2. Who may use Mehfil

You must be legally capable of agreeing to these Terms. Mehfil is not directed to children under 13. A person below the age legally required to consent must use Mehfil only with authorization and supervision from a parent or lawful guardian. Hosts are responsible for deciding whether an event is appropriate for minors and for obtaining permissions required for photographs of children.

3. Accounts, guest sessions and invitation codes

You are responsible for activity through your account or guest session and for protecting login details and invitation codes. Do not access an event without permission, impersonate another person, bypass access controls or use another person's identity information without authorization.

4. Hosts and event access

A host may create an event only where authorized to do so. Hosts can invite and remove guests, moderate uploads, end an event and permanently delete the event. Hosts are not Mehfil's employees or agents. They are responsible for event invitations, participant permissions and reasonable moderation of the event they control.

5. Ownership and the permission you give Mehfil

You retain ownership of content you upload. You grant Mehfil a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, compress, resize, create thumbnails from, display and transmit that content only as reasonably necessary to operate, secure, moderate and legally administer the service. This licence ends when content is deleted, except for short-lived backups, preserved evidence, legal compliance and copies already exported by users.

6. Your upload warranty

Each time you upload, caption, export or share content, you confirm that you created it or have all rights and permissions needed; the intended sharing does not violate privacy, confidentiality, copyright, publicity or other rights; people shown have consented where required; content involving a child is lawful and appropriately authorized; and the material complies with our Content Rules and applicable law.

7. Prohibited content and conduct

You must not upload, possess through the service, publish, transmit, solicit or distribute unlawful or offensive content, including child sexual abuse material; sexual exploitation; non-consensual intimate imagery; unlawful pornography; threats; harassment or cyberstalking; hate or incitement to violence; terrorism-related material; false information prohibited by law; privacy-invasive content; identity misuse; malware; fraud; impersonation; or content that infringes copyright or other rights.

8. User responsibility and Mehfil's role

The uploader, sender and person who exports or republishes content are responsible for their actions and material. Mehfil acts as a service provider and does not undertake to pre-approve every upload. Nothing in these Terms requires blanket proactive monitoring where the law does not impose it. After receiving a report, lawful direction or other specific notice, Mehfil may review and act. A contract cannot remove any duty or liability that the law does not permit us to exclude.

9. Reports, urgent safety, takedowns and appeals

Anyone may report a photo, video or album without logging in through Report content. We may request information needed to identify the material. We may hide, restrict, preserve or remove content; reject a report; suspend accounts or events; prevent further sharing through Mehfil; notify affected users where appropriate; and refer matters to competent authorities. Critical child-safety and non-consensual intimate-content reports target initial review within one hour; high priority within four hours; normal priority within 24 hours; and low priority within 72 hours. These are operational targets, not guaranteed resolution times. A closed or rejected report may be appealed using its reference and reporter email. Do not download or redistribute illegal content merely to report it.

10. Lawful requests and preservation

Mehfil may preserve content, account records and relevant technical information for safety, dispute handling, fraud prevention or compliance with a valid legal request, preservation direction, warrant, court order or regulatory direction. We may disclose information only where permitted or required by applicable law and may challenge unclear or excessive requests where legally and practically appropriate.

11. Deletion, retention and exports

Uploaders can delete their own uploads and hosts can remove event content. Events and cloud photos are scheduled for deletion according to the product retention period, presently 30 days by default during development. A report or legal preservation requirement may temporarily override ordinary deletion. Once a user saves or shares a copy outside Mehfil, that copy is controlled by the recipient, device or external service.

12. Copyright and other rights

A rights holder or authorized representative may report material through the public form. The report should identify the protected work, challenged content, authority and reliable contact details. We may remove or restrict material and may terminate repeat infringers. Knowingly false reports may violate these Terms or law.

13. Suspension and termination

We may warn, restrict, suspend or terminate accounts, guest sessions, uploads or events for serious or repeated violations, safety risks, suspected illegality, interference, fraudulent reporting or legal requirements. Where appropriate, we may allow clarification or appeal. You may stop using Mehfil and delete your account using the in-app control.

14. Service availability and backups

Mehfil is under development and may change or experience interruption. Keep independent copies of important photographs. To the extent permitted by law, the service is provided without a guarantee of uninterrupted availability, permanent storage or fitness for a particular event. Nothing excludes rights or liabilities that cannot lawfully be excluded.

15. Limitation of liability

To the maximum extent permitted by law, Mehfil is not responsible for user-generated content, users' acts, unauthorized redistribution outside the service, loss caused by a user's failure to protect a code or account, or indirect and consequential losses. This does not apply to fraud, wilful misconduct, liability created by Mehfil's specific actual knowledge and intentional participation, or responsibility that law does not permit us to limit.

16. Changes

We may update these Terms for product, safety or legal changes. Material changes will be identified by a new effective date and, where reasonably possible, communicated through the service.
